Fembodied Virtual Studio Liability Waiver and Agreement Terms

By enrolling in and participating in the Fembodied Virtual Studio Membership ("Membership"), you ("Participant") agree to the following terms and conditions. This Liability Waiver and Agreement Terms release [Helena Keppel, Helena Keppel Wellness Consulting, LLC] ("Company") from any and all liability and outlines your responsibilities:

1. Assumption of Risk

Participant understands and agrees that the activities provided within the Membership, including but not limited to Pilates, yoga, dance, flexibility classes, and other movement practices, may involve physical activity that carries inherent risks of injury, discomfort, or harm. By participating, you voluntarily assume all associated risks.

2. Medical Clearance

Participant acknowledges that they are physically fit and have no medical condition that would prevent safe participation in the Membership's activities. It is Participant's sole responsibility to consult a healthcare professional before engaging in these activities.

3. Release of Liability

To the fullest extent permitted by law, Participant releases and holds harmless the Company, its owner(s), instructors, employees, contractors, and affiliates from any and all claims, demands, actions, or causes of action, arising out of or connected to participation in the Membership, including but not limited to injuries, illnesses, damages, or losses incurred during or as a result of these activities.

4. Personal Responsibility

Participant agrees to listen to their body, modify movements as needed, and stop any activity that causes pain, discomfort, or adverse physical reactions. The Company is not responsible for providing medical advice or ensuring Participant's safety.

5. No Guarantees

Participant acknowledges that results from participation in the Membership (e.g., fitness, wellness, personal transformation) may vary and are not guaranteed.

6. Non-Transferable Membership

Membership access is personal to the Participant and may not be transferred, shared, or sold to others without prior written permission from the Company.

7. Intellectual Property

All content provided within the Membership, including videos, routines, and materials, remains the exclusive property of the Company and is intended for personal use only. Reproduction, distribution, or sharing without permission is prohibited.

8. Governing Law and Disputes

This agreement shall be governed by the laws of NY, United States. Any disputes arising from this agreement will be resolved exclusively in the courts of NY, USA.

By enrolling in the Fembodied Virtual Studio Membership, Participant acknowledges that they have read, understood, and voluntarily agreed to this Liability Waiver and Agreement Terms.

Electronic Signature Agreement:
By proceeding with payment and registration, Participant agrees that their electronic acceptance is the legal equivalent of their physical signature.
